Not so long ago, the odds looked dim for legal online gambling in the US. Online poker lobbyists were pushing their own interests, which often meant denouncing online gambling as exclusively luck-based and therefore not in the same league with online poker which is skill-based. The dark days of illegal online gambling on offshore sites and at shady online casinos may soon be over though. An interesting DoJ ruling, which came just before Christmas last year, opened the way to the potentially legalization of online gambling, possibly this year. The DoJ’s ruling concerned the 1961 Wire Act, which – together with the 2006 UIGEA – formed the legal basis of the online gambling and online poker prohibition of recent years. As the legal haze around the whole thing was far from translucent, specialists often speculated that both online poker and gambling were in fact still legal in the US under the existing framework. No legal authority ever troubled clarifying anything in regards to the online gambling/poker case. It appears though that the DoJ has finally had enough of the legal ambiguity and decided to make a few things clear for everyone. According to the above said December ruling, the 1961 Wire Act does not prohibit real money wagering through online channels across state lines. It only prohibits sports betting wagers, and that was indeed the target of the lawmakers who had drafted the Wire Act back in the days.

Nevada had already passed legislation aimed at regulating online gambling and poker and so did DC, and with New Jersey eyeing a similar move, this may all just be the tip of the iceberg.

The question now no longer seems to be whether or not online gambling will be legalized and regulated in 2012, but rather on what level this will happen. The DoJ ruling has virtually unshackled states in the matter: any state that wants to can now legalize and regulate online gambling. Federal lawmakers are currently well aware of the fact that they need to make a move soon if they intend to push through federal regulation, otherwise the states may just beat them to it and regulate things for themselves. Federal-level legalization and regulation would be the preferred way to go according to many, as it would offer better safeguards against illegal and problem gambling and it would tackle regulation issues much more efficiently.

The path that led to the above said DoJ ruling was an interesting one: the ruling came in response to a question the states of New York and Illinois addressed to the DoJ. The two states were seeking clarification in the matter of lottery tickets and the Wire Act’s applicability over the online trading of these tickets. The resulting response was obviously a blessing for the online poker and online gambling industries. The possibilities opened by the ruling are truly bewildering indeed. Sites legalized and regulated in the US will not only be able to accept players from other states, they will also be able to accept players from outside the US. The potential for growth for such operations will therefore be quite limitless.

Affiliates will pop up too and old affiliates will be revived. The entire industry will finally breathe a sigh of relief, like a poker prop does when the monthly rake rebate lands in his poker account. He’s a smart online poker player!

What has been happening at Topboss in the past 6 months

It is hard to believe that we last did a Topboss update in December 2010 – time certainly flies!

What has Topboss been up to during the past 6 months? Quite a lot actually – there has been some good and some bad, but let us start with the bad so that we can end off on a positive note!

Simply put – Our industry is in turmoil at the moment – The online gambling industry was left reeling on April 15 2011, which has been dubbed as “Black Friday” when The US Justice Department unsealed an indictment against the founders of 3 of the largest poker rooms – Full Tilt Poker, Absolute Poker and Poker Stars, seizing their domain names, freezing accounts and shutting them down. A week later they seized various bingo and casino sites which were all allowing USA players. In many cases they arrested the owners and charged them with money laundering offences under the Unlawful Internet Gambling Enforcement Act ( UIGEA )

As a result, American gamblers were left without a legitimate place to bet online and were left wondering if they will ever see the money they have in accounts tied to the now frozen websites. This resulted in many other online casinos closing their doors before they were next on the grizzly Department of Justice list.

One of the programs which closed down was Best Casino Partner, but the problem is that they shut down their affiliate program and did not pay affiliates ( including ourselves ) but they continue to operate their casinos and are still taking deposits from players!! We also had a blow of our own by having to hand over our white label casino – 32 Royal.com to 32 Red PLC who threatened to sue us if we did not hand the domain over to them as they apparently have a trademark on the number “32” . What Judge in their right mind can grant a trademark on a number???? But be that as it may – it was not worth fighting them as 32 Vegas who are owned by William Hill suffered the same fate after a long drawn out court case. The worst of it is that 32 Red had the cheek to send out a press release announcing the seizure of our domain, which makes our blood boil further!!

On the South African front – Piggs Peak announced the date for the appeal of the judgement against them which will determine whether it will be legal for online gamblers from South Africa to play at their casinos. We are keeping our fingers crossed that they win their appeal.

Now onto the good news!

Topboss MediaIn March 2011 we changed our name from Topboss Online to Topboss Media, as this is what we are about – media and advertising. We launched our new website – Topboss Media and our aim is to get a bigger presence on social media networks. What happened at Topboss in 2010

Actually the title of this post is wrong. It should say ” Topboss Frantically finishes the last work before Christmas ” but that wouldn’t all fit in the subject line!!

Seriously, it has been a crazy hectic time for all the guys at Topboss. Asides from computers going on the blink, bee stings and switchboards being hit by lightening – it has been work, work and more work. Our guys certainly deserve a well needed break!

To give you an idea of the kind of pressure they are under – Topboss has nearly 150 live websites which all need to be updated regularly and we own a website design and hosting company which entails the design, maintenance and hosting of many client websites. Never mind all the added extras of liasing with Affiliate Managers, Players, Link Exchanges, Advertising, SEO work, analysing statistics, accounting functions and the usual admin and emails that one has to contend with on a daily basis.

They do all of this and more…but still manage to keep a smile on their faces!

It has been a challenging year at Topboss due to the ever changing gambling laws in the various countries, casinos closing their doors, changing their terms and conditions, changing their tracking links, changing their bonuses, reducing their deposit methods and many other frustrating aspects of the online casino industry.

However, the main thing is that we rode through the storm and are as optimistic as ever!

Sadly, We have stopped our superbike sponsorship, because we unfortunately don’t have the time to maintain the forum nor support the riders as much as we would like to, as we have to concentrate on our core business – namely online casinos and website design. Our riders Nico and Rankin did us proud and are both very talented riders and we wish both of them the best of luck in the future, and hope to still see them on the track making everyone else chew their dust!! We also thank their Team Manager Jacques – Without his guidance, training and support ( never mind his knack of being able to put a whole bike back together before the start of the next race!! ) they would never have achieved such brilliant rankings. Thank You Jacques, Nico and Rankin for giving us a truly enjoyable superbiking year!!

As always we have been very busy bees at Topboss. We have launched our first .co site – Go Slots which has some great slot reviews, including details about the new Lord of the Rings Slot – an exciting microgaming slot based on the popular movie with the same name.

We have also decided to venture into 2 markets that we have not ventured into before – The first is Topboss Affiliates which lists reputable casino affiliate programs. The reason we decided to start this website, is so that new affiliates in the industry do not get taken by the sharks in the industry. We have been in the affiliate industry for 10 years and during this time have come across numerous programs that simply rob affiliates by either not tracking their players, taking their players, not paying or simply closing down the affiliate program but keeping all the players delivered by the affiliate. This is a whole new learning curve for all of us at Topboss, and we will be taking this venture slowly as we will be learning about the industry as we go along. Allen Leonard ( aka The Captain ) Lou Fabiano ( The Professor ) and Ted Lou ( Spearmaster ). These were great guys who gave so much to our industry and made the path smoother for all of us as they were all very vocal in what they believed in and were not shy to approach and put the spot light on affiliate programs that were not honest. RIP Allen, Lou and Ted.
